1. TERMS & CONDITIONS

Tomorrow’s Keepsake Capsule (“TKC”, “we”, “us”, “our”) provides a digital memory service designed to help parents create and preserve keepsake capsules over time. The service makes use of structured templates and third-party platforms to transform personal moments into a curated digital keepsake. By using our services, you agree to these Terms.

TKC is based in Australia and operates globally. These Terms apply to all users regardless of location.

1.2 User Responsibility

You agree that:

You are solely responsible for all content you provide, including photos, videos, and voice recordings
You have full legal rights and permission to use and submit this content
You are the parent or legal guardian of the child, or have the authority to use the content provided
You understand that this content may include personal and sensitive material

TKC does not verify ownership or permissions of content.

1.3 Content Handling

Content is used only to create your keepsake capsule
Content is provided and managed via third-party platforms (such as Canva)
Original files may be deleted after processing
TKC does not store personal photo libraries
Final outputs (PDF, flipbook, and related formats) may be retained for delivery and backup

1.4 Data Security & Risk

You acknowledge:

No system is completely secure
You share and provide content at your own risk

TKC is not liable for:

Unauthorised access
Data breaches
Loss, theft, or misuse of content

1.5 Third-Party Services

TKC uses third-party platforms, including but not limited to:

Canva
Flipsnack
Stripe (payment processing)

You agree that:

Your content may be processed or stored via these platforms
You are responsible for using these platforms correctly
TKC has no control over their systems

TKC is not responsible for:

Platform downtime
Data loss
Errors made within third-party platforms

1.6 Sharing & Access

You will receive access to your flipbook via a private link
You are solely responsible for how this link is shared

TKC is not responsible for:

Unauthorised access due to sharing
Distribution of your content by others

1.7 Storage & Access

TKC stores final outputs for delivery and backup
HTML5 versions of flipbooks may also be stored

However:

We do not guarantee permanent storage
Access may change due to technical or business reasons

You are strongly advised to:

Download your files
Print your keepsake every 2 years

1.8 Subscription Inclusions

Each subscription includes:

2 personal pages per month
2 world event pages per month
1 video per year
1 voice note per year

Additional content may be purchased separately.

1.9 Subscription, Billing & Cancellation

TKC operates as a monthly subscription designed as a 2-year memory journey
Subscriptions are billed monthly in advance
By subscribing, you authorise recurring charges

You may cancel at any time. However:

No refunds will be issued for completed billing periods
Access to future content will stop upon cancellation
Unused or future pages will be forfeited

You will retain access to all completed content up to your last paid month.

EU & UK Customers: If you are located in the European Union or United Kingdom, you may be entitled to a 14-day cooling-off period under local consumer law. If you have not yet accessed any content, you may request a refund within 14 days of purchase by emailing support@tomorrowskeepsakecapsule.com.

1.10 Pricing

TKC may offer introductory pricing for early subscribers
Standard pricing applies thereafter
Pricing may change at any time for new users
Existing subscribers will retain their agreed pricing unless otherwise stated

1.11 User Participation

The TKC experience relies on your participation. If content is not provided:

That month may remain incomplete
TKC is not responsible for missing or skipped content

1.12 Delivery Timeframes

TKC aims to process content within a reasonable timeframe after submission. Processing times may vary depending on:

Operational workload

1.13 Creative Output

TKC uses pre-designed templates and structured formats. While care is taken to ensure quality:

Layouts and formatting may vary slightly
Final creative decisions remain at the discretion of TKC

1.14 Service Suspension

TKC reserves the right to:

Pause or suspend services if payment is not received
Restrict access until payment is restored

1.15 Service Changes

TKC may modify or update any part of the service at any time, including:

1.16 Data Protection

TKC complies with applicable data protection laws including POPIA, GDPR and the Australian Privacy Act 1988 where relevant. By using TKC, you consent to the collection, processing, and storage of your data as outlined in this document.

1.17 Jurisdiction & Governing Law

This agreement is governed by the laws of New South Wales, Australia.

We comply with applicable consumer protection and privacy laws in the jurisdictions we serve, including:

Australia: Australian Consumer Law (ACL) and Privacy Act 1988
European Union & UK: General Data Protection Regulation (GDPR)
United States: Children’s Online Privacy Protection Act (COPPA)
South Africa: Protection of Personal Information Act (POPIA)

Where local laws provide you with additional rights, those rights are not excluded by these Terms.

1.18 No Guarantees

TKC does not guarantee:

Permanent storage
Continuous availability
Error-free service
Compatibility across all devices

1.19 Limitation of Liability

To the fullest extent permitted by law, TKC shall not be liable for:

Direct or indirect loss
Emotional distress
Loss of data or memories
Financial damages
Consequential or incidental damages

1.20 Indemnity

You agree to indemnify and hold TKC harmless from any claims arising from:

Your content
Your use of the service
Your sharing of content

1.21 Force Majeure

TKC is not responsible for delays or failures caused by events beyond our control, including:

Technical failures
Platform outages
External disruptions

1.22 Changes to Terms

We may update these Terms at any time. Continued use of TKC constitutes acceptance of the updated Terms.

Our service is designed to help parents and guardians capture their child’s story. All account registration, purchases and data collection are directed at parents and guardians only.

We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information without parental consent, please contact us immediately at support@tomorrowskeepsakecapsule.com and we will delete it promptly.

This policy is compliant with the US Children’s Online Privacy Protection Act (COPPA).

2.8 International Users & Data Transfers

TKC is based in Australia. Your data may be stored and processed in Australia.

If you are located in the European Union or United Kingdom, your data is processed in accordance with GDPR. You have the right to access, correct, delete or transfer your data at any time.

If you are located in South Africa, your data is processed in accordance with POPIA.

By using our website, you consent to your data being processed in Australia in accordance with this Privacy Policy.

You should not upload content you are not comfortable sharing digitally. You are responsible for maintaining the confidentiality of your account login details.

5. FINAL ACKNOWLEDGEMENT
